General Information

By requesting to schedule an intake to have a memory quilt made and/or placing an order, you agree to these terms and conditions. Please read them carefully.

 

Products

All of the products that are displayed, sold and offered on this website are made by hand. This means that no two items are exactly the same. The product that you will receive will be different from the example shown on the website. Thus, the look is also different from that of mass production. It may be that sometimes a stain, fraying or other is seen due to the clothing used. This is unavoidable with handmade products.

 

Gift Vouchers

Gift vouchers can be purchased via e-mail or contact form. The gift voucher will be sent by email upon receipt of payment. No shipping costs will be charged for sending gift vouchers.

 

The nature, value, duration, expiration and/or any other applicable terms of use can be found on the voucher. Each voucher is valid for a certain period. The voucher cannot be used after its expiration date.

 

Each voucher has a unique code made up of a combination of numbers and letters. Each voucher/code is only provided once. Please keep the code safe. No reimbursement will be offered in the event of voucher loss, theft of the code or its unauthorized use by third parties. Only original codes can be used, and will be provided upon request. In the event of improper use, Blue Sky Bubble reserves the right to require payment in cash. 

 

Gift vouchers and their remaining balances are not redeemable for cash, and cannot be returned. If the total amount of the order exceeds the value of the gift voucher/s used, the difference must be paid by bank transfer. 

 

Every (attempted) fraud or other unauthorized act shall be registered, and will lead to the use of the gift voucher being denied. Gift vouchers may not in any way be used for commercial purposes and/or purposes other than those for which they were issued. The policy on gift vouchers may be amended from time to time. We encourage you to view the voucher conditions for the use of each gift voucher. With the use of a gift voucher, you accept the gift voucher terms and conditions.

 

Placing Orders and Special Offers

Orders can be placed by e-mail or through the website by following the instructions therein. BlueSkyBubble has the right to not accept orders without having to provide justification. All offers listed on the site are valid for as long as they are on the website.

 

Pricing

BlueSkyBubble reserves the right to inform you in the event of type or printing errors. Prices are subject to change without notice. All prices include VAT and packaging costs, inclusive of shipping within the Netherlands, and exclusive of shipping outside of the Netherlands. BlueSkyBubble products are provided at the prices displayed at the date of order. 

 

Payment

Full payment must be received within 14 days after the invoice date. If payment has not been received within this period, your order can be cancelled. Production and delivery of the ordered goods takes place after the payment has been made and your clothes have been received. 

 

Clothing

BlueSkyBubble makes items to order from the clothes that customer provides. The customer is responsible for shipping the clothing as well as their related shipping costs to BlueSkyBubble. If the clothes have not been  received prior to the scheduled intake date, your order may be cancelled. Unused clothes and/or other materials can be returned if requested. Cut clothes and scraps will not be returned. 

 

Receipt and Shipment

BlueSkyBubble can not be held liable for loss or damage to goods during shipment by mail.

 

Warranty

The buyer is obliged to check the delivered goods immediately upon receipt. Should the goods delivered be incorrect, inadequate or incomplete, the customer must immediately report these defects in writing to BlueSkyBubble before proceeding to return said goods.  Any defect or faulty goods shall be reported in writing up to 2 months after delivery from BlueSkyBubble. Goods must be returned in their original packaging (including their accessories and documentation), in new condition. Use of goods following the detection of a failure, damage occurring after the detection of a failure, trouble and/or resale after a detection of failure makes the right to make claims and returns void.

 

This warranty does not apply if: a) the customer is in default to BlueSkyBubble; b) the customer has repaired the delivered goods themselves and/or had them repaired/modified by a third party. c) the delivered goods have been exposed to abnormal conditions or otherwise carelessly handled, treated contrary to the instructions provided by BlueSkyBubble and/or instructions on its packaging. d) the goods were defective in whole or in part the result of regulations that the government has made or will make regarding the nature or quality of the materials used.

BlueSkyBubble is never responsible for the suitability of products in application by each individual customer, nor for any advice regarding the use or application of the goods themselves.​

 

Returns

It is not possible to return items that are are made to order. 

 

Force Majeure

Without prejudice to its other rights, in cases of force majeure, BlueSkyBubble has the right to suspend the execution of your order or terminate the agreement without judicial intervention, providing notice in writing to the client; such may take place without BlueSkyBubble being held liable for any damages, unless deemed not to meet the standards of reasonableness and fairness. Force majeure implies serious business disruptions at BlueSkyBubble and transport issues.

 

Liability

The customer assumes the risk of products from the time when the products are delivered and received at the address provided. BlueSkyBubble cannot be held responsible for any physical damage, both tangible or intangible, that may result from the malfunction or misuse of the products that it sells.

 

Applicable law

Dutch law shall apply to all of the rights, obligations, offers, orders and agreements to which these general conditions apply, including these terms and conditions. In the event of discrepancies in the interpretation of the contents and scope of these general conditions, the Dutch text will prevail.
